I was off absent on previous occasions with stress and my employer was fully aware. My job role changed and the demands of me became excessive, I regularly complained to the employer.
I went off absent when I could take no more. I have gone back now on part time medical grounds.

Since I have gone back the employer has now stated to me that two job roles are to be amalgamatd and I am not to be considered due to my stress problems. He has not and will not consider adjustments, he has not done a stress risk assesment, he states he is to give the role to a more junior colleague - this role comes with the deputy managers role also which I was doing before my abscence. He has admitted this today infront of the union rep.

What are people views. I am trying to put the case together prior to going off lack of duty of care and now this. This is making me not want to be in the work place and increasing my stress levels.

Your obviously in a Union, you obviously know the rules and regulations about tribunals. As you will see on this site so many people do not join Unions then ask what can I do my employers is making my life hell. can I take them to court or to a tribunal.

Stress should never be accepted in the work place and any decent employer would put in place methods to make the work place less stressful.
